Please read these Terms of Service ("Terms") carefully before using the website or engaging the services of Business ROI Media ("Company," "we," "us," or "our").
Business ROI Media provides AI-powered marketing strategy, paid advertising management, lead generation systems, and related consulting services. All services are subject to a separate statement of work or proposal agreed upon by both parties.
WE DO NOT GUARANTEE SPECIFIC RESULTS, ROI, LEAD VOLUME, COST PER LEAD, OR ANY PARTICULAR OUTCOME. Marketing performance depends on numerous factors outside our control, including but not limited to your offer, pricing, competition, creative quality, budget, platform policies, market conditions, and execution. Any projections or case studies are illustrative only.
You are responsible for providing accurate information, timely feedback, access to necessary accounts (Google Ads, Meta, CRM, etc.), and for the legality and quality of your offers and creative assets.
Fees are as agreed in your proposal or statement of work. Payment terms are net 15 unless otherwise specified. Late payments may result in suspension of services.
Upon full payment, you own the final deliverables created specifically for you. We retain rights to our methodologies, AI models, templates, and pre-existing intellectual property.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
Either party may terminate services as outlined in the applicable statement of work. Upon termination, you remain responsible for fees incurred up to the termination date.
These Terms are governed by the laws of the State of New Hampshire without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New Hampshire.
These Terms, together with any proposal or statement of work, constitute the entire agreement between you and Business ROI Media regarding the services.
